These Terms & Conditions ("Terms") govern your access to and use of DataCar (the "Platform"), operated by Ifcon Technology Sdn Bhd (Company No. 200901036809) ("we", "us", "our"). By purchasing a report through the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Who We Are and What We Offer

DataCar allows users to purchase vehicle history and inspection reports ("Reports") for used cars registered in Malaysia by submitting a vehicle registration number and completing payment. Reports are compiled from data sources available to us at the time of purchase and are generated and delivered electronically.

2. Eligibility and Buying Without an Account

  • You must be at least 18 years old, or have the consent of a parent or guardian, to use the Platform.
  • No registration is required. You buy a Report by entering the vehicle number, your name, email address and phone number at checkout, and we email the Report to the address you give us.
  • Each order carries a six-character order number. Anyone holding that number can open the Report at /track-order, so please keep it to yourself.
  • You must provide accurate and current information at checkout. An incorrect email address means we cannot deliver your Report.

3. Orders, Pricing and Payment

  • Prices shown on the Platform are in Malaysian Ringgit (RM) and are inclusive of any applicable Sales and Service Tax (SST), unless stated otherwise.
  • Payment is processed through our appointed third-party payment gateway. We do not store your full card or banking credentials.
  • An order is only confirmed once payment has been successfully received. A tax invoice or e-Invoice (where applicable) will be made available to you after payment.
  • Promotional codes and coupons are subject to their own terms, validity periods, and usage limits, and may be withdrawn or amended at any time without notice.

4. Report Delivery and Accuracy

  • Reports are typically generated and emailed to you shortly after successful payment, and can be re-opened at any time at /track-order using your order number. Delivery times are estimates and not guaranteed.
  • Reports are compiled based on information available from our data sources at the point of generation. We make reasonable efforts to ensure accuracy but do not warrant that a Report is complete, error-free, or up to date, as the underlying data is supplied by third parties outside of our control.
  • A Report is provided for general reference purposes only and should not be the sole basis for any purchase, financing, insurance, or legal decision relating to a vehicle. You are encouraged to conduct your own independent inspection and verification before relying on any Report.

5. Prohibited Uses

You agree not to:

  • use the Platform for any unlawful purpose, including to harass, defraud, or harm any person;
  • attempt to gain unauthorised access to the Platform, other users' accounts, or our systems;
  • scrape, resell, sublicense, or redistribute Reports or Platform content in bulk or for commercial purposes without our prior written consent;
  • reverse engineer, decompile, or otherwise attempt to extract the source code of the Platform.

6. Intellectual Property

All content, branding, software, and Report formatting on the Platform are the property of Ifcon Technology Sdn Bhd or its licensors and are protected by applicable intellectual property laws. Purchasing a Report grants you a limited, non-exclusive, non-transferable licence to use that Report for your personal or internal business reference only.

7. Limitation of Liability

To the fullest extent permitted by law, Ifcon Technology Sdn Bhd shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of, or inability to use, the Platform or any Report, including loss of profit, loss of a vehicle purchase opportunity, or reliance on inaccurate third-party data. Our total aggregate liability for any claim arising out of these Terms shall not exceed the amount you paid for the Report giving rise to the claim.

8. Indemnity

You agree to indemnify and hold Ifcon Technology Sdn Bhd, its officers, employees, and agents harmless from any claim, loss, or demand made by any third party arising out of your breach of these Terms or misuse of the Platform.

9. Suspension and Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or misused the Platform.

10. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
