PDPA NOTICE

This Notice is issued by Ifcon Technology Sdn Bhd (Company No. 200901036809) ("we", "us", "our") in accordance with Section 7 of the Personal Data Protection Act 2010 ("PDPA"), which requires us to inform you about the personal data we process about you in connection with DataCar (the "Platform").

1. Classes of Personal Data Collected

We may collect and process the following classes of personal data about you:

• full name;
• mobile phone number and email address;
• vehicle registration numbers you search or purchase Reports for;
• order, payment, and billing/e-Invoice information;
• correspondence and communications you have with us; and
• technical data such as IP address and device/browser information.

2. Purposes of Collection and Processing

Your personal data is collected and processed for the following purposes:

• to register and authenticate your account via phone number and OTP;
• to process orders, payments, and deliver Reports;
• to issue tax invoices and e-Invoices in compliance with Malaysian tax law;
• to provide customer support and respond to your enquiries or complaints;
• to send service-related notices and, where you have given consent, marketing communications;
• to maintain the security of the Platform and prevent fraud; and
• to comply with applicable laws, regulations, and requests from competent authorities.

3. Source of Your Personal Data

We collect personal data directly from you when you register an account, verify your phone number, place an order, or contact us. We may also receive limited technical data automatically through your use of the Platform.

4. Disclosure of Personal Data

Your personal data may be disclosed to our payment gateway provider, SMS/OTP delivery provider, the Inland Revenue Board of Malaysia (LHDN) for e-Invoicing purposes, our professional advisors, and other parties as required or permitted by law. We do not sell your personal data to third parties.

5. Right to Request Access and Correction

Under Sections 30 and 31 of the PDPA, you have the right to request access to, and correction of, your personal data held by us. To make such a request, please write to us using the contact details below. We may charge a reasonable processing fee as permitted under the PDPA and may require proof of your identity before processing your request.

6. Right to Limit Processing

You may request that we cease or limit processing your personal data for a specific purpose, such as marketing. Please note that limiting processing for certain purposes (for example, OTP verification or payment processing) may mean we are unable to continue providing the Platform's services to you.

7. Consequence of Failing to Supply Personal Data

Where the personal data requested is mandatory (for example, your phone number for OTP verification, or billing details for e-Invoicing), failure to supply such data will mean we are unable to create your account, process your order, or deliver a Report to you.

8. Security of Personal Data

We take reasonable technical, physical, and organisational measures to protect your personal data from loss, misuse, unauthorised access, disclosure, alteration, or destruction, in accordance with the Security Principle under the PDPA.

9. Retention Period

We retain personal data only for as long as necessary to fulfil the purposes set out in this Notice, or as required by applicable law (including tax and e-Invoice record-keeping obligations), after which it will be securely deleted or anonymised.

10. Consent

By submitting your personal data to us, including through registering an account or verifying your phone number by OTP, you consent to the collection, use, and disclosure of your personal data as described in this Notice and our Privacy Policy.
